SMS Terms & Conditions

1. Program Descriptions

Evercool Heating & Air (“we,” “us,” or “our”) operates two separate SMS messaging programs:

• Marketing SMS Program — Promotional messages including seasonal offers, service specials, maintenance reminders, and company announcements sent to customers who have opted in to receive marketing communications.
• Non-Marketing SMS Program — Transactional and service-related messages including HVAC repair and replacement information, pricing, estimates, appointment confirmations, appointment reminders, and other communications directly related to services you have requested or are receiving from Evercool Heating & Air.

2. Consent

Participation in either SMS program requires your prior express written consent, provided by checking the applicable opt-in checkbox on our contact or estimate request forms. Each program requires a separate, independent opt-in. Consent to one program does not constitute consent to the other.

Consent to receive text messages is never required as a condition of purchasing any goods or services from Evercool Heating & Air.

3. Message Frequency

Message frequency varies. For the Marketing SMS Program, you may receive periodic promotional messages based on current offers and seasonal activity. For the Non-Marketing SMS Program, message frequency depends on your service interactions, appointment schedule, and active service requests. You will not receive messages from a program you have not opted into.

4. Message and Data Rates

Standard message and data rates may apply to all SMS messages sent to and received from Evercool Heating & Air. These charges are billed by and payable to your mobile carrier. Contact your wireless carrier for details about your messaging plan and applicable rates.

5. How to Opt Out (STOP)

You may cancel your participation in any SMS program at any time by replying STOP to any message you receive from that program. After opting out, you will receive a single one-time confirmation message confirming your opt-out. No further messages will be sent from that program unless you re-subscribe.

Opting out of one program does not affect your enrollment in the other. If you wish to opt out of both programs, reply STOP to a message from each program separately.

7. Carrier Liability

Wireless carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission from your network operator and is outside the control of Evercool Heating & Air. We are not responsible for any delays or failures in message delivery caused by your carrier or network conditions.

8. Mobile Information Protection

Mobile information and SMS opt-in data will not be shared with third parties or affiliates for their marketing or promotional purposes.

Your mobile phone number and SMS consent data are used solely to deliver the SMS program(s) you have opted into and to maintain records of that consent. This information may be shared with our SMS service provider(s) solely to facilitate message delivery on our behalf, subject to confidentiality obligations. It will not be sold, rented, or otherwise disclosed to any third party for their own marketing or promotional use.

9. Consent Records

When you opt in to an SMS program through one of our forms, we record your consent selection, the date and time of consent, the form source, and the version of the consent language presented to you. These records are retained to document your consent and comply with applicable telecommunications regulations, including A2P 10DLC requirements.
